TICKET SELLER AGREEMENT

Red Eye Tickets issues tickets on behalf of the independent event producers and promoters, therefore Red Eye Tickets cannot be held responsible for the nature and quality of the corresponding events. Disputes of the event price, or disputes in which an event does not meet the expectations of the ticket buyer, must be addressed to the organizer of the event exclusively. Event producers and promoters, and their venue staff, reserve the right to revoke admission to any attendee violating local rules and regulations.

Red Eye Tickets, LLC, and Red Eye Tickets staff, are not liable for any injury, death, or personal property loss at any events using Red Eye Tickets as a ticketing service provider.

TICKET COST

List Price- Event Organizers set the List Price for all ticket tiers.

Fees- All tickets are assessed a single fee in addition to the Ticket’s List Price. It is comprised of:

Sales Tax: calculated according to region in which event takes place and are added to purchase total at time of check out. Taxes are paid by Red Eye Tickets to the respective State and/or Local Government Tax Authorities.

Credit Card Processing: Red Eye Tickets employs the services of Stripe™ to securely process credit card payments at a rate of 2.9% plus 10 cents per transaction.

Service Fee: Red Eye Tickets collects a service commission of 6%, which includes customer support, fraud prevention and dispute resolution, site promotion, and listing services.

Ticket sellers and buyers agree to the Terms and Conditions of Red Eye Tickets regarding Refunds, Exchanges, and Cancellation of Events at http://redeyetickets.com/terms-conditions/, unless expressly notated in this agreement otherwise.

FULFILLMENT

After a successful completed purchase, a ticket PDF will be sent via email from Red Eye Tickets to the attendee. If purchasing tickets on someone else’s behalf, the ticket buyer will enter the intended recipient’s name and email address as directed. All ticketing on Red Eye Tickets is digital through PDF QR codes. NO PHYSICAL TICKETS WILL BE ISSUED, AND WILL CALL THE DAY OF THE EVENT IS THE RESPONSIBILITY OF THE EVENT PRODUCER AND/OR SELLER USING THE TICKERA APP DIGITAL CHECK-IN OR A PRINTED GUEST LIST UNLESS THE SELLER HAS PURCHASED OUR “ON-SITE BOX OFFICE STAFF” FOR AN ADDITIONAL FEE.

DISBURSEMENTS

Event Organizers are required to complete and return a standard US Government W9 form to Red Eye Tickets before any disbursements can be issued. Upon event completion (final date of scheduled event(s)), Red Eye Tickets will provide a settlement breakdown and issue a check via mail for all funds owed to the Event Organizer. Settlements will be processed and funds disbursed within 5 business days of the final date of the scheduled event. Disbursement checks will be mailed to the address provided on the required W9 form unless otherwise requested by the client.

CANCELLATIONS

In the event an Event Organizer is forced to cancel an event due to a Force Majeure (see Terms and Conditions) including but not limited to pandemic specific complications (Government ordered lockdowns, case infections preventing an artist(s) from fulfilling their obligations) or for any other reasonable cause, Red Eye Tickets assures a full refund will be issued to all ticket purchasers.

I hereby confirm I am authorized to act on behalf of the Event including and not limited to receiving all entitled funds after event completion.
I also agree that all event details provided to Red Eye Tickets are accurate and that the Event operates in accordance within the confines of the laws in the locality which the event takes place.
I acknowledge that acting solely as a ticket processing agency, Red Eye Tickets is not responsible for the quality or satisfaction of the event, and is hereby held harmless for any accident, injury or other misfortune that may occur in relation to the event
I acknowledge that any individual contacts provided to me (including but not limited to names, addresses, e-mail addresses and phone numbers) in relation to the event shall not be sold or traded to any third party, in compliance with the Red Eye Tickets Terms and Conditions.
I agree that any costs incurred due to ticket purchase disputes or chargebacks that arise or are resolved after the event settlement and disbursement takes place are my responsibility, as the Event Organizer, and will be invoiced by Red Eye Tickets.
